PRIVACY POLICY – INNOVATIVE TIME SOLUTIONS INC.

At Innovative Time Solutions Inc. (“the Company”, “we”), we respect and take your privacy seriously. We have established the following Privacy Policy for your protection and so that you may better understand what information we collect, how we collect, use and disclose the information collected, and how you can update or correct it. In this way you can make an informed decision when using the Company’s software as a services.

1. This Policy applies to all of the Company owned websites (including the Calemazoo web solution, Calemazoo.com and the Calemazoo iOS and Android mobile applications), (collectively called the “Company Services”).

2. This Policy does not apply to other companies’ or organizations’ websites to which you may sync to. You should carefully review the privacy policies of those websites in order to determine how they treat your personal information.

3. This policy does not apply to the practices of companies or websites that the Company does not own or control, or to people that the Company does not employ or manage.

The Company Services are used by businesses and organizations (incorporated or otherwise (“Organizations”) who register and/or subscribe for the Company Services and by individual users (employed or otherwise) (“Individuals”, “you”), who register as users (collectively “Members”). We collect information in connection with the operation, maintenance and usage of the Company Services. The use of information collected is limited to the purpose of providing the Company Services and operating Calemazoo. The Company Services provide Members with the ability to connect with other Members, to see who and what is available and the approximate distance away of those Members, and to simultaneously share a Member’s own availability with other Members on their terms through a set of permissions. The Company Services combine a personal calendar and a social network with a powerful workforce scheduling solution to allow Members to make more efficient use of their time. By accessing the Company Services, Members are consenting to the information collection and use practices described in this Privacy Policy. If you do not agree to the terms of this Privacy Policy, do not access or use the Company Services.

Information Members Provide

In connection with the Company Services, Businesses and or Individual Members may choose to upload, publish or otherwise display, or share with others (collectively “provide”) certain material, including contact information, photos, personal information, text, and or any other content (collectively the “User Content”) on or through the Company Services. You agree that you are providing the User Content at your own risk and the Company and its directors, employees, partners or agents are not responsible for the use, confidentiality, disclosure or security of such User Content; This Privacy policy is not applicable to User Content you publically provide.

The Types of Information We Collect

1. Individual Registration

When an Individual registers to use the Company Services, we collect certain registration information from the Individual. This includes the Individual’s name, email address and the password to be used by the Individual (collectively “Registration Information”).

2. Organization Registration

When an Organization registers to use the Company Services, we collect certain registration information from the Organization. This includes the Organization name, email address and password to be used by the Organization, contact information for the Organization representative including a telephone number, how many people within an Organization and how does the Organization schedule. (collectively “Registration Information”).

3. Billing Information

When a Member subscribes to paid Company Services, we will collect billing information from the Member such as full legal name, billing address, credit card number, expiry date and security code.

4. Third Party Information

The Company Services may be linked to a Facebook account, integrated with a local smart phone’s contacts and synced with Google or iCal personal calendars at your direction. If you choose to use link with other accounts, the Company Services will have access to profile information and calendars you wish to integrate with.

5. Other Information Collected from Members

In connection with the Company Services, we may also collect certain information about Members and their operations, including but not limited to, the geographical location of the Member, a general description of the Member including profile picture and hours of operation, names of contacts, any input and/or upload of schedule information by a Member, etc. (collectively “Member Information”).

6. Aggregate Data

We also collect aggregate information from Members of the Company Services regarding the Member’s systems and their usage of the Company Services (“Aggregate Site Usage Information”). This includes but is not limited to:

– Information derived from the web browsers of Members of the Company Services including information derived from “cookies”, IP addresses, or similar technology;

– Internet Protocol addresses collected from server logs, traffic and volume statistical data;

– Frequency of visits;

– Type and time of transactions;

– Statistical data;

– Browser type;

– Operating system;

– Activity of site;

– Links to external sites; and

– Volume statistical information, etc.

7. Analytics

We use third party tracking services such as Google Analytics to track and analyze information from users of our Company Services, however such information does not typically include personally-identifiable information about individual users. In the event our analytics reveal metrics about individual users, those metrics are kept internal to the Company. Google Analytics and third part tracking services may use cookies to help track user behaviour. The use of these cookies is not covered by this privacy policy as we do not have access or control over them.

Cookies and Web Beacons

We use “cookies“ on our websites. Cookies are pieces of information or data sent to your browser from a web server and stored on your computer’s hard drive for record-keeping purposes. Cookies tell our computer that you’ve visited before and help to make your visit more personal so you don’t’ have to re-enter info on a return visit. Cookies also allow us to count the number of unique and return visitors who use the Company Services. Most browsers are initially set up to accept cookies. If you prefer, you can reset your browser to notify you when you have received a cookie or, alternatively, to refuse to accept cookies. It is important to note that you may not be able to use certain features or participate in certain offerings using the Company Services and mobile apps if you choose not to accept cookies. Our websites also may contain electronic images known as web beacons (sometimes called single-pixel gifs), that allow us to count the number of users who have visited specific pages. We may include web beacons in promotional email messages or newsletters in order to determine whether messages have been opened and acted upon.

IP Addresses

We collect and analyze traffic on our websites by keeping track of the IP addresses of our visitors. An IP address is a unique number assigned to your computer when you are using your browser on the Internet. We log this information so that we can monitor things like the number of visitors visiting the websites; however, we do not link your IP address to any personally identifying information.

Personalizing Your Experience on the Websites.

We try to personalize your experience using the Company Services by tracking event requests, shift requests, vacation requests, shift trade requests, etc. and other content you may have sent or received. From time to time, we may send you surveys or solicit your feedback. We use surveys to gauge Member interest in new features and premium services we may offer, as well as to try to enhance your experience with using the Company Services, by creating additional services, or optimizing those services that already exist. We will ask for and always welcome your feedback on features and functionality. We may also use the information to alert you to offers, products contests and events in which you may be interested in.

Use of Personal Information

We do not share your personal information with third parties for direct marketing purposes nor sell information that identifies you as an individual. We may use the Personal Information we collect (including any information from other applications where you have consented to our accessing what is stored in the application) as follows:

Account Information

1. To provide and improve the Company Services

2. To sign you in to your account or to reference your account;

3. For our internal records, tracking, and business purposes;

4. To give access and send notices to other Members as you direct through the mobile app or websites;

5. To send you push notifications and emails relative to items such as events and contacts;

6. To contact you in order to provide updates on new features, policies, procedures or about your account; and

7. To contact you to respond to your questions or to provide you with technical support.

Third Party Account Information

As of July 8, 2015, we do not engage in any third party or corporate affiliates’ direct marketing either via email or through the use of cookies or other technical means within the websites and mobile apps and therefore do not use your username or email address for such purposes. We are therefore not subject to the requirements of the California Civil Code 1798.83-1798.84

Disclosure Exceptions

Not withstanding the above policies, we reserve the right to disclose your personal information to appropriate third parties if we are required to do so by law or we believe that such action is necessary:

1. To comply with legal process such as a search warrant, subpoena or court order;

2. To protect the Company’s rights and property

3. To investigate reports of users sending material using a false email address or users sending harassing, threatening, or abusive messages;

4. To protect Innovative Time Solutions Inc. against misuse or unauthorized use of our Websites and/or the Company Services; or

5. During emergencies, such as when we believe someone’s physical safety is at risk.

Sale of Assets

In the event that Innovative Time Solutions Inc. and/or its products, units or subsidiaries are ever sold, acquired, merged, liquidated, reorganized, or otherwise transferred, we reserve the right to transfer our user databases together with any personally identifiable information contained therein, to a third party acquiring Innovative Time Solutions Inc. assets. It is Innovative Time Solutions Inc. practice to seek appropriate protection for information in these types of transactions.

Data Security

Innovative Time Solutions is committed to protecting the security of your personal information. The Company has implemented technologies, processes and procedures (collectively, “Safeguards”) designed to protect the information it collects and stores. These Safeguards include:

– A secure hosting environment;

– Encrypted password protection;

– A user interface with user defined permission levels and encrypted passwords

– Authentication standards upon user registration through email verification; designed to prevent access to data of third parties;

– 128-256 bit SSL encryption of all data transmissions via the Company Services. SSL is the industry standard security technology for establishing an encrypted link between a web server and a browser;

– Additional mobile <> server encryption;

– Automatic daily system backups; and

– Encrypted server access based on permissions by the Company’s employees and system administrators.

The Company has employed firewalls and other advanced security technologies, which we believe are reasonably sufficient to safeguard adequately information we collect from unauthorized access from outside intruders. Registered users are assigned a unique user name and password, which are required to access their account. It is the user’s responsibility to protect the security of their user name and password. Unauthorized entry or use or disclosures, hardware, or software failures, and other factors may compromise the security of the information we collect and store. We are not responsible for circumvention of any privacy settings of Safeguards used in connection with Company Services.

Privacy

The Company Service is hosted in the United States. If you use the Company Services from outside the United States, you are voluntarily transferring information (potentially including personal information) and content to the United States.

Use Common Sense in All Your Online Activities

Even the best Privacy Policy cannot protect your online privacy and security in all circumstances. Unscrupulous advertisers, hackers, and scam artists are constantly searching the Internet looking for new targets. Your best protection is to understand the limits to privacy on the Internet and use common sense in all of your online activities. Accessing and Updating Registration and Contact Information To update your record/account information, log on to the service and go to available user settings.

Termination of Account

Members can cancel their account at any time. If you choose to cancel your account, please be aware that your account and access to the account will be deleted permanently. Any collected information in our databases will be safely and confidentially deleted or disposed of in accordance with the Personal Information Protection Act. Note, we may retain residual/historical information in our databases for audit, legal or other purposes.

Communications; Email Opt-Out

As part of using the Company Services, you agree that we may contact you and send you communications as part of our ongoing business relationship. We may also, from time to time, send you certain promotional emails/communications so that you are aware of our latest products, services, contests and events. If you wish to stop receiving promotional emails/communications, you may opt out by checking the unsubscribe option on such communications.

Compliance with Children’s Online Privacy Protection Act

Innovative Time Solutions does not knowingly collect information from children under 13 years of age and does not target its websites to collect information from children under 13 years of age. Children should always get permission from their parents before sending information about themselves over the internet. If a child has provided us with personal information without permission, we ask that any concerned parent or guardian of the child contact us.

Changes to the Privacy Policy

We reserve the right to change this Privacy Policy. When we do, we will revise the “last updated” date at the top and bottom of the Privacy Policy. If we decide to make material changes to the Privacy Policy, we will notify you by placing a notice on the Company websites and in the Mobile Apps. We will obtain your opt-in consent for any updates to this privacy statement that materially expand the sharing or use of the your personal information in ways not disclosed in the privacy statement at the time of collection. If you do not agree with the changes, you always have the option to terminate your account and stop using the Company Services.

Applicable Law

If you choose to use the Company Services, your use and any dispute over privacy is subject to this Privacy Policy and the Company Terms of Use including limitations of damages and governing law. By using the Company Services, you agree that the laws of British Columbia, Canada, govern this privacy policy and any dispute of any sort that might arise between you and the Company to the exclusion of conflicts of laws.
